Tipping the Scales: Complying with the Aarhus Convention on Access to Environmental Justice
This report briefly examines Scotland’s Aarhus Convention obligations in relation to access to justice in environmental matters and the reality individuals, communities and NGOs face when they try to go to court to defend the environment.
It concludes that recent government moves to properly implement the final Pillar of Aarhus could fall far short of compliance, and recommends that we build on learning from other jurisdictions to create fully Aarhus compliant access to justice.
