Evidence to Justice Committee on Civil Litigation Bill

Evidence to the Scottish Parliament’s Justice Committee on the Civil Litigation (Expenses and Group Proceedings) (Scotland) Bill. Our evidence, as part of the SE LINK Legal Strategy Subgroup:

• calls on the Scottish Government to urgently undertake a comprehensive review of the legal system in relation to Aarhus obligations;
• urges the Committee to take the opportunity presented in this Bill to ask the Scottish Government how it is going to address the deficiencies in Scotland’s implementation of the Aarhus Convention; and
• recommends amending the Bill to include all litigation that falls under the scope of the Aarhus Convention in provisions for Qualified One Way Cost Shifting, and thereby move some way towards compliance.
